General Terms and Conditions (AGB)

  1. Scope of application
    All purchase contracts between Grillland.ch GmbH (seller) and its customers (buyers) are based on the present
    General Terms and Conditions (GTC), unless otherwise agreed in writing in individual cases
    . Should individual provisions of the GTC be legally invalid in whole or in part, the remaining
    provisions shall remain unaffected.
  2. Conclusion of the purchase contract
    A purchase contract is concluded when the seller declares its acceptance after receiving an order.
    Acceptance can be declared either by signing the “Order and order confirmation” form by the
    customer, by receiving the “Order confirmation” form signed by the customer or by a
    confirmation email of the online order.
  3. Order and order confirmation
    The details in the form “Order and
    order confirmation” are decisive for the type, quantity and price of the goods, as well as for the transportation costs.
  4. Delivery
    The seller undertakes to deliver the goods to the address specified by the customer. The buyer undertakes
    to check the goods immediately for completeness and perfect condition.
  5. Delivery date
    The delivery date shall be met by the Seller to the best of its ability and shall generally be announced by telephone 3-5 days in advance
    . For deliveries on call, a delivery period of 1-3 weeks from the date of the call shall apply,
    provided that the goods are in stock at the time of the call. Exceeding the delivery deadline does not entitle the buyer to
    withdraw from the purchase contract, nor to refuse acceptance of the goods, nor to claim damages. However, if the agreed delivery period is exceeded by more than 3 weeks, the buyer is
    entitled to demand replacement goods on loan from the
    seller. These replacement goods will be selected by the seller. The Buyer shall handle the replacement goods with care
    and return them to the Seller in proper condition. The Seller shall be liable for any additional
    transportation costs incurred.
  6. Collection by the customer
    If the goods are collected from the seller, it is the responsibility of the customer to check them on site for completeness and
    perfect condition. The Buyer is responsible for the proper loading and transportation of the
    goods.
  7. Warranty
    The seller guarantees that any defects in the design and material of the purchased item will be rectified. Claims
    of the buyer are excluded, in particular those for direct and indirect damage. Any defects
    must be reported immediately upon discovery. The dimensions of the fire bowls and barbecues may vary slightly,
    as everything is handmade. All information without guarantee. The warranty period is generally 2 years from the date of
    delivery or collection by the customer. An extended warranty exists in the following cases.

    The warranty does not cover damage caused by wear and tear, ageing, improper handling, e.g. scratches or
    other environmental and animal influences. The seller is entitled, but not obliged, to procure replacement goods for the purchased item instead of rectifying the defect
    .
  8. Adjustment of published prices
    The seller reserves the right to adjust published prices at any time.
  9. Temporary absence of minor parts
    The temporary absence of minor parts from the order does not entitle the customer to postpone due payments.
  10. Retention of title
    The seller retains title to the ordered goods until they have been paid for in full and is entitled
    to have the retention of title entered in the official register at the customer’s expense if necessary.
  11. Cancellation of contract
    In the event that the customer refuses to accept the purchased item or cancels the purchase contract, the customer
    will be charged a cancellation fee of 25% of the agreed purchase price for the damage.
  12. Applicable law and place of jurisdiction
    The legal relationship is subject to Swiss law. The exclusive place of jurisdiction is Liestal BL
